These General Terms and Conditions apply to all treatments, products, appointments, offers and agreements between NovaSkin and the client/consumer. By using our website and services, you agree to these terms.

Article 1 – Definitions
In these General Terms and Conditions, the following definitions apply:
- NovaSkin: the company NovaSkin, registered with the Chamber of Commerce under number 67726380, located at Arnhemseweg 189, 7331 BJ Apeldoorn.
- Entrepreneur: the natural or legal person who offers products, (access to) digital content and/or services remotely to consumers.
- Client: the natural person or legal entity who undergoes a treatment at NovaSkin and/or purchases products.
- Consumer: any client who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
- Treatment: any skin therapeutic or beauty treatment performed by NovaSkin, including laser, peels, skin improvement, consultations and related services.
- Products: all skincare and skin improvement products and related items offered by NovaSkin, sold both in the practice and online.
- Webshop: the digital environment of NovaSkin where products can be purchased remotely.
- Agreement: any treatment or purchase of products agreed between NovaSkin and the client/consumer.
- Distance contract: agreement where consumer and NovaSkin are not simultaneously physically present (such as webshop orders), whereby up to and including the conclusion of the agreement exclusive or partial use is made of one or more means of distance communication.
- Cooling-off period: the statutory period within which a consumer can exercise the right of withdrawal for webshop purchases.
- Right of withdrawal: the right of the consumer to return a webshop order within the cooling-off period.
- Day: calendar day.
- Digital content: data produced and supplied in digital form.
- Durable data carrier: any means – including email – that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation or use for a period appropriate to the purpose for which the information is intended, and that allows unchanged reproduction of the stored information.
- Model withdrawal form: the European model withdrawal form included in these terms and conditions.
- Supplementary agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract and these goods, digital content and/or services are supplied by the entrepreneur or by a third party based on an agreement between that third party and the entrepreneur.
- Means of distance communication: means that can be used to conclude an agreement, without the consumer and entrepreneur having to be together in the same room at the same time.
- General Terms and Conditions: this legal document of NovaSkin.

NovaSkin operates according to the guidelines of ANBOS and the Dutch Association of Skin Therapists (NVH), insofar as applicable to the services offered.
Article 3 – Applicability
- These General Terms and Conditions apply to all treatments, products, appointments, offers and agreements between NovaSkin and the client/consumer.
- Deviations from these terms are only valid if agreed in writing.
- The terms have been made available before or during the conclusion of the agreement or made digitally accessible.
- If the distance contract is concluded electronically, the text of these General Terms and Conditions shall be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable data carrier.
- In the event that specific product or service conditions apply in addition to these general terms and conditions, the consumer may, in the case of conflicting conditions, always invoke the applicable provision that is most favorable to them.
- If a provision is found to be void or is annulled, the remaining provisions remain fully in force and the relevant provision shall be replaced without delay in mutual consultation by a provision that approximates the purpose of the original as closely as possible.
- In situations not covered by these terms, action will be taken in the spirit of these terms.
- Ambiguities about the interpretation or content of one or more provisions of our terms and conditions must be interpreted in the spirit of these general terms and conditions.
Article 4 – The offer
- All offers are without obligation, unless explicitly stated otherwise.
- Descriptions of treatments and products are sufficiently clear to enable the client/consumer to make a correct choice.
- Obvious errors in the offer (such as spelling or pricing errors) do not bind NovaSkin.
- Photos, results and before/after images are indicative; no rights can be derived from examples.
Article 5 – The agreement
- An agreement is concluded as soon as a customer books a treatment or places an order and NovaSkin confirms this.
- For webshop orders, the agreement arises after the consumer has accepted the offer and met the conditions.
- NovaSkin may refuse an appointment or order if there are health risks, payment arrears or other compelling reasons.
- For electronic agreements, NovaSkin takes appropriate measures to secure data.
- NovaSkin may, within legal frameworks, investigate creditworthiness and relevant facts and on that basis set conditions or refuse an agreement.
Article 6 – Application of the right of withdrawal
- The statutory right of withdrawal only applies to products purchased remotely by a consumer through the NovaSkin webshop.
- For treatments and services performed in the salon, no right of withdrawal applies. These concern care and service appointments that take place on a pre-agreed date and time.
- For treatments, the provisions of Article 6A (cancellation and no-show) apply instead.
Article 7 – Right of withdrawal (webshop products)
- When purchasing products through the webshop, the consumer has a cooling-off period of 14 days, without giving reasons.
- The cooling-off period starts on the day the consumer, or a designated third party, has received the product.
- If one order consists of multiple products delivered separately, the cooling-off period starts on the day the last product is received.
- If NovaSkin has not provided the legally required information about the right of withdrawal, the cooling-off period may be extended in accordance with statutory provisions.
Article 8 – Consumer obligations during the cooling-off period
- The consumer handles the product and packaging with care and may only unpack the product to the extent necessary to determine its nature and operation.
- Depreciation due to further use is at the expense of the consumer.
- If NovaSkin has not informed the consumer about the right of withdrawal, this limitation does not apply.
Article 9 – Exercise of the right of withdrawal and costs
- The consumer notifies the withdrawal within the cooling-off period by means of a clear statement (e.g. email).
- The product is returned within 14 days of this notification.
- Return is made with all accessories and, if possible, in original condition and packaging.
- The costs of return shipment are for the consumer, unless otherwise agreed.
- When exercising the right of withdrawal, additional agreements are automatically dissolved.
Article 10 – NovaSkin obligations upon withdrawal
- Upon receipt of the withdrawal notification, NovaSkin sends a confirmation to the consumer.
- NovaSkin reimburses all payments for the product concerned within 14 days of the withdrawal notification.
- NovaSkin may wait with reimbursement until the product has been received back or the consumer demonstrates that shipment has taken place.
- Reimbursement is made using the same payment method as used for payment, unless otherwise agreed.
- Additional cost for a more luxurious shipping option than standard will not be reimbursed.
Article 11 – Exclusion of right of withdrawal
The entrepreneur may exclude the following products and services from the right of withdrawal, but only if the entrepreneur has clearly stated this in the offer, or at least in good time before the conclusion of the agreement:
- Products or services whose price is subject to fluctuations in the financial market over which the entrepreneur has no influence and which may occur within the withdrawal period.
- Sealed products that for reasons of health protection or hygiene are not suitable for return and whose seal has been broken after delivery.
- Agreements concluded during a public auction.
- Products manufactured according to the consumer's specifications, which are not prefabricated and which are manufactured on the basis of an individual choice or decision of the consumer, or which are clearly intended for a specific person.
- Products that spoil quickly or have a limited shelf life.
- Products that by their nature are irrevocably mixed with other products after delivery.
- Opened, used or damaged products will not be accepted for return.
Article 12 – The price
- The prices of treatments and products offered by NovaSkin include VAT, unless stated otherwise.
- During the validity period indicated in the offer, the prices of the products and/or services offered will not be increased, except for price changes as a result of changes in VAT rates.
- Price increases within 3 months of the conclusion of the agreement are only permitted if they are the result of statutory regulations or provisions.
- Price increases from 3 months after the conclusion of the agreement are only permitted if the entrepreneur has stipulated this and the consumer has the right to terminate the agreement as of the day on which the price increase takes effect.
- All prices are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors. In case of printing and typographical errors, the entrepreneur is not obliged to deliver the product at the incorrect price.
Article 13 – Compliance and additional guarantee
- NovaSkin ensures that delivered treatments and products comply with the agreement and with justified quality expectations.
- Any additional guarantees from manufacturer or supplier do not affect the consumer's statutory rights.
- Guarantee is excluded in case of incorrect, incompetent or deviating use, insufficient compliance with instructions or use not according to purpose.
Article 14 – Delivery and execution (webshop products)
- NovaSkin shall exercise the greatest possible care when receiving and executing orders for products.
- The place of delivery is the address that the consumer has made known to NovaSkin.
- NovaSkin shall execute accepted orders with due speed but no later than within 30 days, unless a different delivery period has been agreed.
- If delivery is delayed, or if an order cannot or can only partially be executed, the consumer shall receive notification of this no later than 30 days after placing the order. In that case, the consumer has the right to dissolve the agreement without costs and is entitled to any compensation.
- After dissolution in accordance with the previous paragraph, NovaSkin shall refund the amount paid by the consumer without delay.
- The risk of damage and/or loss of products rests with NovaSkin until the moment of delivery to the consumer or a representative designated in advance and made known to NovaSkin, unless expressly agreed otherwise.
- Products in the NovaSkin webshop are delivered by PostNL. Delivery takes place Monday through Saturday until 9:30 PM.
Article 15 – Payment
- Payment for treatments in the salon takes place immediately after completion of the treatment, unless otherwise agreed.
- Orders via the webshop must be paid in advance via the offered online payment methods.
- If payment is not made on time, the consumer is in default and NovaSkin may charge reasonable costs for collection or administration.
- In case of payment arrears, NovaSkin may refuse or postpone appointments until payment has been made.
Article 16 – Privacy
- NovaSkin processes personal data exclusively for business purposes such as: scheduling treatments, treatment and file management, product delivery, payments, communication and aftercare.
- Data is processed and stored in accordance with applicable GDPR legislation.
- Data is only shared with third parties if necessary for the execution of the agreement (e.g. payment providers), or when the client has given explicit consent.
- The client has the right to access, correct and delete personal data, insofar as processing is not required by law or regulation.
- NovaSkin's privacy statement is available on the website or will be provided upon request.
Article 17 – Complaints procedure
- NovaSkin has a complaints procedure and handles the complaint in accordance with this complaints procedure.
- Complaints about the execution of the agreement must be submitted to NovaSkin fully and clearly described within a reasonable time after the consumer has discovered the defects.
- Complaints submitted to NovaSkin will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, NovaSkin will respond within the period of 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed answer.
- The consumer must in any case give NovaSkin 4 weeks to resolve the complaint in mutual consultation. After this period, a dispute arises that is subject to the dispute resolution procedure.
- If a complaint cannot be resolved by mutual agreement, the client can submit the complaint to the Disputes Committee of the ANBOS trade association or to the competent court.
Article 18 – Disputes
- Dutch law applies to all agreements and services of NovaSkin.
- Disputes that cannot be resolved by mutual agreement will be submitted exclusively to the competent court in the district where NovaSkin is located.
Article 19 – Additional provisions (including gift vouchers)
- Gift vouchers are not exchangeable for cash.
- Gift vouchers are valid for 1 year from the date of issue, unless otherwise agreed in writing.
- Loss, theft or damage to a gift voucher does not entitle to replacement or refund.
- Gift vouchers can be used for treatments or product purchases in the salon.
Article 20 – Amendments to the General Terms and Conditions
- NovaSkin may amend these General Terms and Conditions.
- Amended conditions will be published on the website and will take effect at the indicated time.
- For ongoing appointments and orders, the conditions that applied at the time of booking/ordering apply.
Article 21 – Access to and changes to the website
- Access to the website is permitted on a temporary basis and NovaSkin reserves the right to withdraw or modify the website without notice. NovaSkin shall not be liable if the website is unavailable for any reason for any period of time.
- From time to time, NovaSkin may restrict access to the website or parts thereof to users who have registered with us.
- If the consumer chooses or receives a user identification, password, or any other information as part of NovaSkin's security procedures, such information must be treated as confidential and must not be disclosed to any third parties.
- NovaSkin has the right to disable any such user identification code or password if, in NovaSkin's opinion, there is failure to comply with the provisions of these terms and conditions.
- NovaSkin intends to update the website regularly and may change the content at any time. Certain information on the website may be out of date at any given time and NovaSkin is not obliged to update such information.
Article 22 – Intellectual property rights
- NovaSkin is the owner or licensee of all intellectual property rights in the website and the information published on it. These works are protected by copyright and other laws and treaties. All such rights are reserved.
- Printing a copy or downloading extracts from the pages of the website is permitted for personal use.
- Paper or digital copies of material that can be printed or downloaded from the website may not be modified. Furthermore, images, photos, videos, audio content, graphics and accompanying texts may not be used without permission.
- None of the information provided on the website may be used for commercial purposes without having received a license from NovaSkin.
- Printed parts of the website, copied or downloaded, where the terms of use are violated, the right to use the website shall immediately cease and copies of the information must be immediately destroyed or returned.
Article 23 – Links to and from the website
- It is permitted to link to the homepage of the NovaSkin website, provided that this is done in a fair and legal manner and does not damage NovaSkin's reputation.
- It is not permitted to create a link in such a way that suggests being part of an association, or that suggests approval or endorsement by NovaSkin where there is none.
- It is not permitted to frame or embed the website in other websites. No link may be created to any part of the website, with the exception of the homepage.
- NovaSkin reserves the right to withdraw permission for a link without notice.
- Where the website contains links to other sites and resources provided by third parties, these links are provided for information purposes only. NovaSkin has no control over the content of these websites or resources and accepts no liability for these websites or any loss or damage arising from their use.
